TERMS AND CONDITIONS
Win one of two $1,000 Forever New wardrobes. By entering ‘Forever New $1,000 wardrobe promotion’, you are agreeing to the following terms and conditions:
1. STANDARD TERMS
Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions for entry. The Promoter is Forever New Clothing Pty Limited (ABN 11 118 100 100).
2. WHO CAN ENTER
Entry open to all Australian residents of NSW, VIC, QLD, ACT, TAS, SA & WA, invited to complete our market research survey only. Directors, management, employees and their immediate families of Forever New Clothing Pty Limited and their associated entities and companies are not eligible to enter. Forever New suppliers and their employees are not eligible to enter.
3. HOW TO ENTER
3.1. The competition commences on Wednesday 10 December 2014 at 5:00pm (AEDT) and concludes on Tuesday 16 December 2014 at 11:59pm (AEDT) (“the Competition Period”).
3.2. To enter the competition, customers must go to click on their survey invitation email, complete the entire survey and answer the final question about Forever New. The final question that must be completed is: ‘In 25 words or less, please describe the perfect Forever New shopping experience'.
3.3. Only one entry per person. One ($1,000) Forever New Gift Card will be awarded to two separately drawn recipients.
3.4. The time of entry will, in each case, be the time that the entry is recorded by the GMI servers (software used for the survey data collection).
3.5. Entries not completed in accordance with these terms or incorrect or incomplete entries will be deemed invalid. This competition is a game of skill. The best response to the final question will determine the winners, from all completed surveys received within the Competition Period.
4. HOW TO WIN
4.1. Each entrant validly entered over the Competition Period will be entered into the competition to win. Two winners of the $1000 Forever New Gift Cards will be selected by Forever New Clothing Pty Limited on Monday 5 January 2015 from all valid entries. The prize winners will be notified by email on Tuesday 6 January 2015.
4.2. In the event of any prize being unclaimed by Tuesday 27 January, 2015, further draw/s will take place to determine replacement winners on that day. The replacement winners will be notified by email on the same day. The winners must claim their prize by responding via email by 10 February, 2015.
4.3. The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.
4.4. It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
4.5. The Promoter reserves the right to request that the winners provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the prize. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
4.6. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions of entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry if of a type described in this clause.
5.1. The prizes are not exchangeable, transferable or redeemable for cash. Any additional charges or tax are the responsibility of the winner. The Promoter accepts no responsibility for any variation in the prize value.
5.2. The prize will be mailed to the winners directly, to the address supplied.
5.3. If the prize or any part of the prize becomes unavailable for reasons beyond the Promoters’ control, the Promoters will endeavour but are not obliged to provide a substitute prize of equivalent value.
5.4. To the full extent permitted by the law, the Promoters exclude liability for any loss, damage or injury whatsoever suffered or sustained (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity revenue or profit) arising directly or indirectly out of or in connection with this promotion.
6. NO LIABILITY
6.1. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or any of the equipment or programming associated with, or utilised in this competition, or for any technical error, or combination thereof that may occur in the course of the administration of this competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or alteration of, entries
6.2. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
6.3. If for any reason, this competition is not capable of running as planned, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition, subject to any written directions given under State Legislation.
6.4. The Promoter is not liable for any lost, damaged, altered or variation in prize value.
