    Loyalty Program Survey – Terms & Conditions

    By participating in the Forever New Customer Feedback Survey ("Survey"), you agree to the following Terms & Conditions. This Survey is conducted by Forever New to collect customer feedback about loyalty programs for internal analysis. 

    Eligibility 

    • Participants must be 18 years or older at the time of entry. 

    • Participants must be residents of Australia. 

    • Employees of Forever New and their immediate family members and affiliated companies and their advertising or promotional agencies are not eligible to participate in the Survey.


    Data Collection & Privacy 

    • The Survey will collect IP addresses and email addresses along with survey responses. 

    • The data collected will be used for internal analysis for Forever New to understand participants’ feedback about loyalty programs and will be handled in accordance with the Forever New Privacy Policy. 

    • By submitting the Survey, you consent to Forever New collecting and processing your data as outlined in these terms. 

    • This Survey is hosted on SurveyMonkey, a third-party survey platform. By participating, you acknowledge that your responses may be processed by SurveyMonkey in accordance with their Privacy Policy and Terms of Use. Forever New is not responsible for SurveyMonkey’s data handling practices. 

    • Your personal information will not be shared with third parties unless required by law. 

    Survey Period 

    • The Survey will commence on Wednesday, 12 March 2025 and will close on Wednesday, 26 March 2025, at 11:59 PM (AEDT). 

    • Forever New reserves the right to extend or modify the Survey period in its discretion. 

     
    Participation 

    • Participation in this Survey is voluntary and does not create any legal rights or obligations. 

    • Each participant may only submit one Survey response. 

    • Forever New reserves the right to disqualify responses that are incomplete, fraudulent, or do not comply with these Terms & Conditions. 


    Limitation of Liability  

    • Forever New is not responsible for any technical issues, interruptions, or errors that may affect survey participation. 

    • Forever New reserves the right to cancel or modify the Survey at any time without prior notice.

    Loyalty Program Survey 2025 – Prize Draw Terms & Conditions

    1. Information on how to enter form part of these Terms and Conditions. Entry into this Prize Draw is deemed to be an acceptance of these Terms and Conditions. 
       

    1. The Prize Draw commences on Wednesday, 12 March 2025 at 9:00AM (AEDT) and concludes on Wednesday, 26 March 2025 at 19.30PM (AEDT) (‘Prize Draw Period’). 
       

    1. The Prize Draw is open to Australian residents who are 18 years of age or older as of the beginning of the Prize Draw Period and who receive an invitation from the Promoter to complete the Forever New online Loyalty Program Survey. 
       

    1. Employees of the Promoter or any of its affiliated companies, their advertising or promotional agencies are not eligible to enter the Prize Draw. 
       

    1. To enter this Prize Draw, entrants must complete and submit the Forever New online Loyalty Program Survey sent to their email address registered with the Promoter, during the Prize Draw Period.  This invitation email cannot be transferred to another email address. 
       
       

    1. Only one entry is permitted per person. Entrants who provide incorrect or fraudulent information are ineligible to participate in the Prize Draw. Any attempt to enter multiple email addresses, or any use of robotic, automatic, programmed or any other entry method not authorized by these Terms and Conditions is not permitted. No responsibility is accepted for any entries that are late, lost, misdirected, or not received by the Promoter within the Prize Draw Period. 
       

    1. There will be 3 winners of this Prize Draw. The first 3 valid entries drawn at random by the Promoter will be declared the prize winners of the Prize Draw. 
       

    1. The Prize Draw will take place on Friday, 28 March 2025 at Building 8, Level 1, 584 Swan St, Burnley, 3121 Victoria, Australia or at another address nominated by the Promoter where the draw is unable to take place at this address. 
       

    1. The Promoter’s decision regarding any aspect of this Prize Draw is final and no correspondence will be entered into. The Promoter reserves the right to verify the validity of all entries and disqualify any entrant who fails to comply with or submits an entry which is not in accordance with the Terms and Conditions. 
       

    1. The winners will be notified via email within 2 working days of the Prize draw date. The Prizes will be distributed to the winners within 1 month after the draw date. 
       

    1. The Prizes must be accepted as awarded and are not transferable or redeemable for cash. Lost, stolen or damaged Prizes will not be replaced or refunded. The maximum total prize pool is AU$450 which is correct at the time of publication. The Promoter accepts no responsibility for any variation in the Prize value. If any element of the Prize is not available due to unforeseen circumstances, the Promoter may provide a substitute prize of equal or greater value. Forever New gift cards are issued subject to the terms and conditions specified on the reverse side of each gift card. Any ancillary costs associated with redeeming a Prize is the sole responsibility of the winner/s. 
       
       

    1. If a Prize remains unclaimed 3 months after the respective draw date, the right of the winner to receive the Prize is extinguished. A substitute prize draw will be held on Monday, 30 June 2025 at Building 8, Level 1, 584 Swan St, Burnley, 3121 VIC, Australia (or at another address nominated by the Promoter where the draw is unable to take place at this address), comprised of all unsuccessful entries in the Prize Draw. The replacement winner will be notified via email or phone within 2 working days of the draw. 
       
       

    1. This Prize Draw may be promoted through third party websites. Entrants must comply with the terms of service for those third-party websites when using them to participate in this Prize Draw. This Prize Draw is in no way sponsored, endorsed or administered by, or associated with, those third-party websites. 
       
       

    1. The Promoter and its associated agencies and companies associated with this Prize Draw and third-party websites referred to in clause 13 will not be liable for any damage or loss whatsoever suffered or sustained regarding this Prize Draw or prizes awarded during this Prize Draw, except for liability which cannot be excluded by law. 
       
       

    1. The Promoter and its associated agencies and companies associated with this Prize Draw and third party websites referred to in clause 13 are not liable for any incorrect, incomplete, or inaccurate information received or not received in the course of or in connection with this Prize Draw or any problems or technical failures if the deficiency is occasioned by any cause outside the Promoter’s reasonable control including but not limited to technical malfunctions or failures. 
       
       

    1. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached these Terms and Conditions or engaged in any unlawful or improper conduct calculated to jeopardize the fair and proper conduct of the Prize Draw. The Promoter also reserves the right to request appropriate identification or other documentation to confirm an entrant’s eligibility to enter and claim a Prize. If the identity of an entrant has not been verified or validated to the Promoter’s satisfaction, that entry will be deemed invalid. 
       
       

    1. If for any reason this Prize Draw is incapable of running as planned, including due to inappropriate content, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to suspend, cancel, terminate or modify or recommence the Prize Draw, subject to the approval or directions of any relevant regulatory authority. 
       
       

    1. At the request of the Promoter, the winners agrees to participate in any promotional activities planned by the Promoter and consent to their name and image being used in the Promoter’s marketing materials. 
       
       

    1. All entries become the property of the Promoter. The Promoter collects personal information in order to conduct this Prize Draw and to conduct the Forever New online Loyalty Program Survey. Entrants who do not fulfill the requirements of the entry process will not be eligible to participate in the Prize Draw. By entering this Prize Draw entrants agree that: (1) the Promoter may disclose personal information to its contractors and agents for the purpose of assisting in the conduct of this Prize Draw; and (2) the Promoter may retain and use personal information for future marketing purposes in relations to its products, services, and offers and for publicity purposes. By subscribing to receive the Promoter’s marketing communications and entering this Prize Draw entrants' consent to the Promoter collecting their personal information in accordance with the Promoter’s privacy policy, a copy of which is available at forevernew.com.au/privacy.
