#ForeverNewStyle Competition Terms & Conditions - AU Only

1. Information on how to enter form part of these Terms and Conditions. Entry into this Competition is deemed to be an acceptance of these Terms and Conditions.
2. The Promotion commences on Friday 13 November 2020 10:00AM (AEDST) and concludes on Friday 5 November 2021 at 11.59PM (AEDST) (‘Competition Period’).
3. The Competition is open to Australian residents who are 18 years of age or older as of the beginning of the Competition Period, who are not an employee of the Promoter or any of its affiliated companies, their advertising or promotional agencies.
4. To enter this Competition, entrants must during the Competition Period:
   (a) Share a photo and/or video on Instagram wearing current season (currently available)

(b) Set their Instagram profile to public for The Promoter’s visibility (the entrant will not be able to enter the competition if their profile is private); and

(c) Tag @forevernew_official in their photo and/or video and use #ForeverNewStyle in the caption.

5. Entrants may enter as many times as they like; however each entry must be unique. Each post counts as an entry. Entrants who provide incorrect or fraudulent information are ineligible to participate in the Competition. Any attempt to enter multiple email addresses or pen names, or any use of robotic, automatic, programmed or any other entry method not authorized by these Terms and Conditions is not permitted. No responsibility is accepted for any entries that are late, lost, misdirected or not received by the Promoter within the Competition Period.
6. This is not a game of chance. The Promoter will select winners based on creativity and originality. The Promoter’s decision regarding any aspect of this Competition is final and no correspondence will be entered into. The Promoter reserves the right to verify the validity of all entries and disqualify any entrant who fails to comply with or submits an entry which is not in accordance with the Terms and Conditions.
7. There will be a total of 24 prizes to be won (2 prizes per month for a 12-month period). Each draw will take place on the first Friday of every month (first draw 4 December 2020, final draw 5 November 2021) at 10:00am AEST/AEDST during the Competition Period. If a Friday falls on a public holiday, that draw will take place on the following business day in Australia. Each prize draw will take place at Building 8, Level 4, 576 Swan St, Burnley, 3121 VIC Australia or at another address nominated by the Promoter where the draw is unable to take place at this address.
8. There will be two (2) winners for each prize draw. The top two selected winners selected from all entries received during the preceding month as outlined in the table below for each draw will each receive one x $150 Forever New gift card (The ‘Prize’). The total prize pool is AUD $3600 AUD.

9. Each winner will be notified via Instagram direct message within 2 working days of the respective draw date (using the account that posted the entry). The winners’ entry posts will be shared on @forevernew_official (Forever New Instagram page) via Instagram story or Instagram feed post. Each Prize will be distributed to winners within 1 month after the respective draw date.
10. The Prize must be accepted as awarded and is not transferable or redeemable for cash. Lost, stolen or damaged Prizes will not be replaced or refunded. Forever New gift cards are issued subject to the terms and conditions specified on the reverse side of each gift card. Any ancillary costs associated with redeeming a Prize is the sole responsibility of each winner.
11. If any Prize remains unclaimed after 3 months of the respective draw date, the right of the respective winner to receive the Prize is extinguished. A new prize draw will be held on the first Friday of the month, 3 months after the initial draw date at Building 8, Level 4, 576 Swan St, Burnley, 3121 VIC, Australia (or at another address nominated by the Promoter where the draw is unable to take place at this address), comprised of all entries who have entered the Competition. The replacement winner(s) will be notified via Instagram direct message within 2 working days of the draw and their entry post/s will be shared on the Forever New Instagram page.
12. This Competition may be promoted through third party websites, such as Facebook and Instagram. Entrants must comply with the terms of service for those third party websites when using them to participate in this Competition. This Competition is in no way sponsored, endorsed or administered by, or associated with, those third party websites.
13. The Promoter and its associated agencies and companies associated with this Competition and third party websites referred to in clause 12 will not be liable for any damage or loss whatsoever suffered or sustained regarding this Competition or prizes awarded in the course of this Competition, except for liability which cannot be excluded by law.
14. The Promoter and third party websites referred to in clause 12 is not liable for any incorrect, incomplete, or inaccurate information received or not received in the course of or in connection with this Competition if the deficiency is occasioned by any cause outside the Promoter’s reasonable control including but not limited to technical malfunctions or failures.
15. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached these Terms and Conditions, or engaged in any unlawful or improper conduct calculated to jeopardize the fair and proper conduct of the Competition. The Promoter also reserves the right to request appropriate identification or other documentation to confirm an entrant’s eligibility to enter and claim a Prize. If the identity of an entrant has not been verified or validated to the Promoter’s satisfaction, that entry will be deemed invalid.
16. If for any reason this Competition is incapable of running as planned, including due to inappropriate content, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to suspend, cancel, terminate or modify or recommence the Competition, subject to the approval or directions of the relevant regulatory authority.
17. At the request of the Promoter, all winners agree to participate in any promotional activities planned by the Promoter and consent to their name and image being used in the Promoter’s marketing materials and Forever New Instagram page.
18. All entries become the property of the Promoter. The Promoter collects personal information in order to conduct this Competition. Entrants who do not fulfill the requirements of the entry process will not be eligible to participate in the Competition. By entering this Competition entrants agree that: (1) the Promoter may disclose personal information to its contractors and agents for the purpose of assisting in the conduct of this Competition; and (2) the Promoter may retain and use personal information for future marketing purposes in relations to its products, services, and offers and for publicity purposes. By subscribing to receive the Promoter’s marketing communications and entering this Competition entrants consent to the Promoter collecting their personal information in accordance with the Promoter’s privacy policy, a copy of which is available at the Forever New Website.
